Terms of Service

1. Agreement to Terms

By downloading, installing, or using Helm for Mac (the "App"), you agree to be bound by these Terms of Service ("Terms"). The App is provided by BestSelf Co. ("BestSelf," "we," "us," or "our"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Helm for Mac is a digital wellbeing application that helps you manage screen time, block distracting apps, and maintain focus through structured sessions. The App uses macOS system features including Apple's Screen Time framework to provide app blocking functionality.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, subject to these Terms. You may not:

• Copy, modify, or create derivative works of the App
• Reverse-engineer, disassemble, or decompile the App
• Distribute, sublicense, lease, or lend the App to third parties
• Use the App for any unlawful purpose
• Attempt to circumvent any security features of the App

4. Subscriptions and Payments

Free and Premium Features

Helm offers both free features and premium features available through a paid subscription ("Helm Pro").

Billing

• Subscriptions purchased through the Mac App Store are billed by Apple according to Apple's terms.
• Subscriptions purchased directly through our website are billed by our payment processor (Stripe).
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

Cancellation

• App Store purchases: Manage or cancel your subscription through System Settings > Apple ID > Subscriptions.
• Direct purchases: Cancel through your account settings at bestself.co or by contacting support@bestselfco.com.

Refunds

• For App Store purchases, refund requests must be submitted to Apple directly.
• For direct purchases, we offer refunds within 30 days of purchase. Contact support@bestselfco.com from the email used to make the purchase.

5. System Permissions

Helm requires certain macOS permissions to function:

• Screen Time / Family Controls: Required to block apps during focus sessions. This is an Apple system-level feature; Helm cannot access your usage data through this API.
• Accessibility (optional): May be used for enhanced blocking features.
• Notifications: Used to alert you about session status and breaks.

You can revoke these permissions at any time through macOS System Settings, though this may limit the App's functionality.

6. User Responsibilities

You are responsible for:

• Maintaining the security of your account credentials
• All activity that occurs under your account
• Using the App in compliance with applicable laws
• Understanding that app blocking is a self-management tool, not a parental control or security product

7. Intellectual Property

The App, including its design, features, code, content, and branding, is owned by BestSelf Co. and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand features.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• App blocking will be 100% effective in all circumstances
• The App will be compatible with all hardware or software configurations
• Any defects will be corrected

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BESTSELF CO. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.

Our total liability for any claim arising from these Terms or the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless BestSelf Co., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the App or violation of these Terms.

11. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our discretion. Upon termination:

• Your license to use the App is revoked
• You must uninstall the App
• Provisions that by their nature should survive termination will survive (including warranty disclaimers, limitation of liability, and indemnification)

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through the App or via email. Continued use of the App after changes constitutes acceptance of the updated Terms. If you disagree with changes, stop using the App and cancel your subscription.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws provisions. Any disputes shall be resolved in the courts located in Delaware.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BestSelf Co. regarding the App.
