Terms of Service
Welcome to Helm! These Terms of Service ("Terms") govern your use of our products. References to our products in these Terms refer to the Helm physical device, the Helm mobile application, and any related services we provide ("Product" or "Products").
In addition to these terms, we publish a Privacy Policy that describes how we process, collect, use, and protect your information.
Who We Are
The Products are provided by BestSelf Co. ("BestSelf," "we," "us," or "our").
Account Creation and Purchases
Creating an Account
To use the Helm app, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Purchasing Helm
Helm is available as a one-time purchase. When you purchase Helm:
- You receive the physical Helm device
- You receive a license to use the Helm app
- You are responsible for all applicable taxes
- We'll charge tax when required by law
Refunds and Returns
- Physical Device: You may return the Helm device within 30 days of delivery for a full refund if you're not satisfied
- Defective Products: We'll replace any defective Helm device within one year of purchase
- Digital Services: Access to the Helm app is included with your device purchase and is non-refundable separately
- Shipping: You're responsible for return shipping costs unless the product is defective
Product Warranty
The Helm device comes with a one-year limited warranty against defects in materials and workmanship under normal use. This warranty does not cover:
- Damage from misuse, accidents, or normal wear and tear
- Damage from improper storage or handling
- Cosmetic damage that doesn't affect functionality
- Damage from unauthorized modifications
Your Ownership of Your Data and Our Limited Use
Your Data
"User Content" refers to the information you create through your use of Helm, including: focus session data (duration, frequency, timing), profile settings and preferences, achievement data and statistics, session notes and reflections, and app blocking preferences (stored locally on your device only).
You own your User Content. We need limited permissions to provide our Products to you.
License You Grant Us
You grant us a license to your User Content for the limited purposes of operating and providing the Helm service, syncing your data across your devices, providing insights and analytics about your focus patterns, improving our Products (in anonymized, aggregated form), and troubleshooting and providing customer support.
We will not sell or license your User Content to third parties. The license you grant us is worldwide, non-exclusive, royalty-free, and for as long as you use our Products.
Important Privacy Feature: Your app blocking choices remain entirely on your device. We do not collect, store, or have access to information about which specific apps you choose to block or allow during focus sessions.
Our Intellectual Property Rights
Software License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Helm app solely in connection with your Helm device. This license is for personal, non-commercial use only.
Our Property
The Products, including the Helm device design, app, logos, and all related intellectual property, are owned by BestSelf Co. and protected by copyright, trademark, and other laws. Except for the limited license above, we reserve all rights.
Feedback
We welcome your feedback about Helm. By providing feedback, you agree that we can use it without restriction or compensation to you.
Using Helm Properly
Minimum Age
You must be at least 18 years old to purchase Helm. If you're between 13 and 18, you may use Helm with parental permission and supervision.
Your Responsibilities
When using our Products, you agree not to:
- Reverse engineer, decompile, or disassemble any part of our Products
- Attempt to bypass or disable any security features
- Use the Products for any illegal purposes
- Resell or commercially distribute the Products without permission
- Create derivative works based on our Products
- Use automated systems to access our services
- Interfere with other users' use of the Products
- Impersonate others or create fake accounts
- Upload malicious code or content
- Violate any applicable laws or regulations
Account Termination
By You
You may stop using Helm at any time. To delete your account, use the option in the app settings or contact us.
By Us
We may suspend or terminate your account if you violate these Terms, use the Products in harmful ways, don't use your account for 24 consecutive months, or if required by law. We'll try to notify you before termination unless you're in material breach, notification would cause us legal liability, or we're prohibited by law from notifying you.
Effects of Termination
When your account is terminated, you lose access to the Helm app, your data may be deleted (export it first!), and sections of these Terms that should naturally survive will remain in effect.
Changes to Our Products
We continuously improve Helm and may add, modify, or remove features, release updates, or change the app interface or functionality. If we make significant changes that negatively affect your use of Helm, we'll notify you in advance when reasonably possible.
Third-Party Services
Our Products may contain links to third-party websites or services. We're not responsible for these external services or their content. Helm integrates with your phone's built-in features (like Focus modes on iOS or Digital Wellbeing on Android). We're not responsible for changes to these features by Apple, Google, or other manufacturers.
Disclaimers and Limitations
Warranty Disclaimer
EXCEPT FOR THE EXPRESS PRODUCT WARRANTY STATED ABOVE, THE PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BESTSELF AND ITS AFFILIATES WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, DATA, OR OPPORTUNITIES, OR AMOUNTS EXCEEDING WHAT YOU PAID FOR HELM IN THE PAST 12 MONTHS. THIS LIMITATION APPLIES EVEN IF WE KNEW OR SHOULD HAVE KNOWN ABOUT THE POSSIBILITY OF DAMAGES. Some jurisdictions don't allow these limitations, so they may not apply to you.
Resolving Disputes
Talk to Us First
Before filing any legal claim, please contact us at legal@bestself.co to try to resolve the issue informally. We'll attempt to resolve disputes in good faith.

If we can't resolve the dispute informally within 30 days, either party may send a formal Notice of Dispute by certified mail to:

Governing Law and Venue
These Terms are governed by Delaware law (without regard to conflict of laws principles). Any legal proceedings must be brought in Delaware courts, except as otherwise required by law.
Arbitration and Class Action Waiver (U.S. Residents)
YOU AND BESTSELF AGREE TO RESOLVE DISPUTES THROUGH BINDING ARBITRATION INSTEAD OF COURT (EXCEPT AS PROVIDED BELOW). Claims relating to these Terms or our Products will be resolved through binding arbitration by a single arbitrator, administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
You may opt out of arbitration by emailing legal@bestself.co within 30 days of first accepting these Terms. Include "Arbitration Opt-Out" in the subject line.
The following disputes may be brought in court: small claims court matters, intellectual property infringement claims, and requests for injunctive relief.
You may only bring claims individually. Class actions, class arbitrations, and representative actions are not permitted. If this provision is found unenforceable, the entire arbitration agreement is void.
General Terms
These Terms and our Privacy Policy constitute the entire agreement between you and BestSelf regarding Helm. We may update these Terms to reflect changes in laws, our Products, or our business practices, and will notify you of material changes via email, in-app notifications, or our website. Continued use after changes means you accept the new Terms. If any provision is found unenforceable, the rest of the Terms remain in effect.
